Federal prosecutors in the Middle District of Alabama unsealed a second superseding indictment on August 12, 2026, adding Heidi Beirich — the former director of the Southern Poverty Law Center’s Intelligence Project — as an individual defendant. The charges are conspiracy to commit wire fraud, conspiracy to submit false statements to a federally insured bank, conspiracy to commit concealment money laundering, and a substantive concealment money laundering count. The government alleges that between 2007 and 2023 more than $4 million in tax-deductible donations moved through accounts opened in the names of fictitious companies — Rare Books Warehouse, Fox Photography, Center Investigative Agency and six others — at Synovus Bank and its Sterling Bank subsidiary, and out to roughly fifty people inside violent extremist organizations. It further alleges that Beirich lived with one of those paid sources and that about $140,000 of donor money landed in bank accounts the two of them shared between 2015 and 2021.

The talking heads are already running the same defense: this is normal, the FBI runs sources too, and donors not knowing the details isn’t fraud. It isn’t normal, and it isn’t intelligence. The FBI does run sources, and those sources do sometimes commit crimes — but every one of them sits under a supervisory special agent, then a chain of directors and deputies, then the Director, then the Attorney General, then the Judiciary and Oversight Committees of both chambers, then the President, with civil rights litigation running up through the courts to the Supreme Court. That is what makes it intelligence rather than an operation. The accountability chain alleged here ran from the director of the program into her own household and her own bank accounts and stopped. And what the money allegedly bought was not observation. Paying to recruit members and provision the events you are telling your donors you exist to stop is not source handling — it is provokatsiya, the KGB and Stasi practice of manufacturing the enemy you are funded to fight. The question headed for a jury is narrower and blunter than any of that: does opening an account for a bookstore that doesn’t exist count as a false statement to a bank. They just might say yes. Consider it in the same vein as the Steele dossier prosecutions that appear ahead — covert methods used to build political narratives from whole cloth, on U.S. soil.

Beirich’s counsel says she is innocent, that the case is without merit, and that the prosecution is politically motivated. The organization has pleaded not guilty. An indictment is an allegation and every defendant is presumed innocent.
